Terms of Service for Wash Doctors Limited “Automate” Booking Software

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the www.getautomate.io website and the Automate online booking, payment, scheduling, and marketing software (the "Service") operated by Wash Doctors Limited ("us", "we", or "our").Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

‍1. Definitions-Service Provider" refers to the Valeting and Detailing businesses that sign up to use our Service."End-User" refers to the customers of Service Providers who use the booking portal provided by our Service."Automate" refers to the online booking, payment, scheduling, and marketing software provided by Wash Doctors Limited.2. Description of Service2.1. Automate is an online software platform designed specifically for Valeting and Detailing businesses. It provides the following core functionalities:a) Online Booking: Allows End-Users to book services directly through the Service Provider’s website or booking portal.b) Payment Processing: Facilitates secure online payments for bookings and services.c) Scheduling: Provides tools for Service Provider’s to manage their service schedules efficiently.d) Marketing: Offers marketing features to help Service Providers promote their services.2.2. The exact features available to a Service Provider depend on their chosen subscription tier.

‍3. Account Terms
‍3.1. You must be a Valeting or Detailing business operating in the United Kingdom to use Automate.

3.2. You must provide your legal business name, a valid email address, and any other information requested in order to complete the signup process.

3.3. You are responsible for maintaining the security of your account and password. Wash Doctors Limited cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

3.4. You are responsible for all content posted and activity that occurs under your account.3.5. You may not use the Service for any illegal or unauthorised purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

‍4. Subscription and Payment Terms

‍4.1. The Service is offered on a subscription basis with three tiers, each providing different levels of access to the features of the Service.

4.2. Subscriptions must be paid monthly. You will be billed in advance on a recurring and periodic basis ("Billing Cycle").

4.3. At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or Wash Doctors Limited cancels it.

4.4. Unpaid subscriptions will result in the removal of services until the subscription is paid. Wash Doctors Limited reserves the right to suspend or terminate your account for non-payment.

4.5. You may cancel your subscription at any time by emailing hello@getautomate.io. An email request to this address is the only accepted method of cancellation.

4.6. You will receive a full refund if the cancellation request is made within 14 days of your initial purchase. After that, refunds are at our discretion and will only be provided in accordance with UK consumer protection laws.

4.7. If you cancel the Service before the end of your current paid-up month, your cancellation will take effect at the end of that billing cycle.

4.8. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

‍5. Modifications to the Service and Prices

‍5.1. Wash Doctors Limited reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

5.2. Prices of all Services, including but not limited to monthly subscription plan fees, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Wash Doctors Limited website or the Service itself.

‍6. Use of End-User Data

‍6.1. You agree that Wash Doctors Limited may access and use End-User data as reasonably necessary to provide, maintain and improve the Service.

6.2. You are responsible for obtaining all necessary consents from End-Users for the collection, use, and processing of their personal data through the Service.

6.3. You agree to comply with all applicable data protection laws, including but not limited to the UK GDPR and the Data Protection Act 2018

‍7. Intellectual Property Rights

‍7.1. The Service and its original content, features, and functionality are and will remain the exclusive property of Wash Doctors Limited and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries.

7.2. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Wash Doctors Limited.

‍8. Disclaimer of Warranties

‍8.1. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

8.2. Wash Doctors Limited does not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

‍9. Limitation of Liability

‍To the fullest extent permitted by applicable law, in no event will Wash Doctors Limited, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable for any indirect, special, incidental, consequential, exemplary or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

‍These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions

‍We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
